A lawsuit filed in Denver District Civil Court against Denver Broncos wide receiver Demaryius Thomas has been dismissed, The Denver Post reported.
The suit stems from Thomas’ alleged involvement in former Broncos’ cornerback Perrish Cox’s sexual assault case. Cox, a reserve cornerback with the 49ers, was acquitted on two charges of sexual assault in March 2012.
Although Thomas was never charged in the case, he was considered a witness in the alleged incident.
The dismissal relates to Thomas only and is not related to claims against Cox, the Post reported. Cox repeatedly denied sexually assaulting the alleged victim in December 2010. Thomas said they met the alleged victim and a friend at a Denver nightclub on the night of the incident.
Thomas then took both of them home early the next day, according to KUSA-TV in Denver. He admitted kissing the alleged victim before the alleged sexual assault took place, KUSA-TV reported.
Denver District Court Judge Martin Egelhoff signed an order on Jan. 10 to dismiss all claims against Thomas.
“Plaintiff and Thomas have acknowledged the other has admitted no fault, wrongdoing, liability, or obligation to one another,” Egelhoff wrote in the order, according to the Post.
Cox has 20 tackles and two pass break-ups in 2012.
Thomas finished fourth in the NFL this season in receiving yards with 1,434 and led the AFC in catches of 20-plus yards with 29.
